Drunk Driving and Driving Bans in Hungary: What Foreigners Should Know

As a criminal law expert practicing in Hungary, I frequently represent foreign clients who face DUI (driving under the influence) cases. Over the years, I have guided many tourists and expatriates through the complex legal system, helping them understand their rights and navigate the consequences of drunk driving in Hungary.

In this article, I will address the most important questions that foreigners often ask when dealing with DUI cases in Hungary, including:

  • What are the legal blood alcohol limits, and how does Hungarian law define drunk driving?

  • What penalties can a driver face, from fines to imprisonment?

  • How does a Hungarian driving ban affect foreign drivers and their licences?

  • What happens if a foreign driving licence is taken by Hungarian authorities?

  • Are there rehabilitation programs or alcohol interlock requirements?

By the end of this guide, readers will have a clear understanding of how Hungary handles drunk driving, what risks they face, and what steps they should take if involved in a DUI case.

Zero Tolerance for Alcohol in Hungary

Hungary enforces a zero-tolerance policy for alcohol consumption while driving. This means any detectable level of alcohol in a driver’s system can lead to legal consequences. The legal blood alcohol concentration (BAC) limit is 0.0 g/l for all drivers. Even a slight amount of alcohol can result in fines, driving bans, or criminal charges, depending on the BAC level and circumstances. (GOV.UK)

Legal Consequences Based on BAC Levels

Hungarian law classifies BAC levels into different categories, each with specific legal implications:

  • 0.0 – 0.3 g/l: Alcohol consumption can be established, but it is not considered an alcohol-affected state. This qualifies as an infraction.

  • 0.31 – 0.5 g/l: Alcohol consumption can be established, but it is not considered an alcohol-affected state. This qualifies as an infraction.

  • 0.51 – 0.8 g/l: Very mild alcohol influence.

  • 0.81 – 1.5 g/l: Mild alcohol influence.

  • 1.51 – 2.5 g/l: Moderate alcohol influence.

  • 2.51 – 3.5 g/l: Severe alcohol influence.

  • Above 3.5 g/l: Very severe alcohol influence.

Punishments vary based on the level of intoxication and other factors.

Sanctions for Drunk Driving

Drunk driving in Hungary is punishable under the Criminal Code, with potential penalties including:

  • Fines: Monetary penalties vary depending on the severity of the offense.

  • Driving Ban: A mandatory driving disqualification ranging from 1 month to 10 years, depending on the circumstances.

  • Rehabilitation Course: Offenders may be required to attend a retraining or rehabilitation course, especially if the disqualification period is over 6 months.

  • Imprisonment: In severe cases, especially if the driver caused injury or death, imprisonment may be imposed.

Repeat offenders or those with high BAC levels face more severe consequences.

Foreign Driving Licences and Hungarian Driving Bans

If a foreign driver is caught driving under the influence in Hungary, the consequences depend on the type of driving licence:

  • Hungarian Driving Licence: The driving ban applies throughout the European Union.

  • Foreign (EU) Driving Licence: The driving ban applies only in Hungary. However, the Hungarian authorities may forward the foreign licence to the issuing country, and the driver may need to collect it back once the ban expires.

  • Non-EU Driving Licence: The driving ban applies only in Hungary. The driver may continue driving in their home country unless their home country decides to extend the ban.

It’s important to note that driving bans are enforced based on the type of licence held and the issuing country’s regulations.

Scooters and Other Vehicles: Foreigners Should Be Careful

In Hungary, the rules for DUI apply not only to cars and motorcycles, but also to electric scooters, mopeds, and similar vehicles. Many tourists may assume that riding a small scooter is exempt from traffic laws, but this is not the case.

  • Classification as a vehicle: Under Hungarian law, scooters and mopeds are considered motor vehicles if they are motorized, meaning that driving them under the influence of alcohol is treated the same as driving a car.

  • Consequences for DUI: If a tourist is caught riding a scooter while intoxicated, Hungarian authorities can impose fines, initiate criminal proceedings, and even revoke the driving licence of the rider.

  • Foreign licences: Even if you hold a foreign driving licence, a DUI offence on a scooter can result in the temporary seizure of your licence, which will be forwarded to the issuing authority in your home country.

Tourists should therefore exercise the same caution on scooters as they would when driving a car, and never ride under the influence of alcohol, even for short distances.

Rehabilitation and Alcohol Interlock Programmes

Hungary does not currently have a nationwide alcohol interlock rehabilitation programme. However, if a court imposes a full suspension of the driver’s licence for a period exceeding 6 months, the offender is obliged to follow a rehabilitation course. The cost of such a course ranges from €170 to €345. (ETSC)

Key Takeaways for Foreign Drivers in Hungary

  • Zero Tolerance: Any detectable alcohol in the system can lead to legal consequences.

  • Driving Bans: A driving ban with a Hungarian licence applies across the entire EU. A ban with a foreign licence applies only in Hungary, unless extended by the home country.

  • Rehabilitation: Offenders may be required to attend a rehabilitation course, especially if the disqualification period is over 6 months.

  • Legal Advice: It’s advisable to consult a legal professional if involved in a drunk driving incident in Hungary.
